Update 5.12.21 - Industry Leader Weekly Update - CHANGES TO GUIDANCE EFFECTIVE IMMEDIATELY

Public Health Orders Update - EFFECTIVE IMMEDIATELY: Shown properties, like open-houses...

The state has just updated its guidance on open houses and further updates are pending.  The following is now on live at https://covid19.ca.gov/industry-guidance/.  C.A.R. will be providing more details regarding this guidance so that REALTORS® are in full compliance, but the following is the current information on the California State official website.

Shown properties, like open houses – effective immediately

In-person showings of properties, like open houses, are permitted and must follow the indoor gatherings capacity limits in the CDPH gatherings guidance. Check the Attendance section of the gatherings guidance for the capacity limits for each tier. People who feel sick or have COVID-19 symptoms are not permitted to attend. Physical distancing between different households must be maintained, and hand sanitizer should be made available. Face coverings are required. See the CDPH guidance for the use of face coverings for complete details and exceptions. All other restrictions in the real estate guidance remain in place.

Review the guidance, prepare a plan, and post the checklist for the real estate industry PDF in your workplace to show customers and employees that you’ve reduced the risk and are open for business.

Market Update

The aggregate statistics point to an overall market that continues to do well. Mortgage applications have been growing for almost a year consecutively, rates remain below 3%, and the pandemic is subsiding and allowing a more robust economic recovery to begin to take root. However, even as the broader picture continues to improve, many factors also show that a rising tide is only lifting some boats in our industry. Many REALTORS® are optimistic, but far fewer are experiencing a boost in their own business from robust macro conditions and homebuyers are growing increasingly pessimistic about housing as supply and affordability deteriorate in today’s hot market. Legislative Update

Of note are C.A.R. supported SB 476 (Min) and AB 874 (Quirk-Silva).  Both bills concern additional protections for those who are considering or have PACE loans on their homes.  C.A.R. was a leader in the effort on protections in this area, as our members were among the first to see the abuses that were going on and have in the past sponsored, co-sponsored or supported consumer protection legislation including co-sponsored AB 1284 (Dababneh) in 2017 and last year’s sponsored AB 1551 (Arambula) both of which were signed into law.

SB 668 (Bates) would have delayed implementation of certain provision of Proposition 19.  C.A.R. along with the California Professional Firefighters opposed the provisions on various grounds including that it was likely unconstitutional.  While the bill’s proponents and opponents were given the opportunity to voice their positions in the scheduled hearing, the bill was not put up for a vote and will not be moving forward.  SB 539 (Hertzberg) is going to be the implementation bill for Prop 19 and is intended to encompass and address, or at a minimum vet, all the implementation issues that parties are raising including those raised in SB 668.  Obviously those provisions which would require a constitutional amendment cannot be addressed but at least it will clearly identify those as part of the process. Our goal in doing this is to make sure this important segment of our membership is seen and heard but also we will provide this group with valuable information regarding Proposition 19 and the latest legislative update from Senior VP of Governmental Affairs, Sanjay Wagle. He will be joined by Supervising Senior Counsel, Robert Bloom who can also provide information on hot legal topics and the new peer to peer ethics line.
